Goals

Goals need to be set realistically at an attainable level while still being challenging. Time and ability are the best goals to set because they can be measured, and their improvement develops more motivation.

Attitude

It’s important to note that excellence and perfection are separate and distinct. Excellence is attainable and perfection is unreachable. A positive attitude helps an athlete distinguish these and find success through excellence.

Motivation

Without motivation, athletes would find it impossible to continue toward their goals. It is a mindset of awareness, a drive to tirelessly push forward. Why is it important for young people to understand the justice system and the rule of law?

The rule of law is at the heart of all cultures. UK residents benefit from a trialled, tested and reformed justice system. Although there is arguably always room for improvement, and the system may not always appear fair, the rule of law is a fundamental building block and central focus. Not all countries benefit from a working rule of law and it may be something we take for granted. Futures can be shaped by the rule of law.

Why is access to justice important?

In my field, I assist claimants from Toton in Nottingham in pursuing an action for damages against their treating clinician in circumstances whereby there has been a breach of their professional duty of care, causing additional injury and loss.

Whatever sport you play, there’s always the risk of suffering an injury. Although many sports carry a risk of injury, some carry a much greater risk of serious injuries such as horse riding, skiing, climbing, and motorsports, to name a few of the sports that are more dangerous than others.

As the world scrambles to get to grips with the coronavirus outbreak, global sporting events are taking a hit. There are now more than 88,000 confirmed cases of the virus around the world and the death toll is over 3,000 -- the majority of which are from mainland China. The World Health Organization is preparing for a potential pandemic, so it seems the list of sports affected by the virus will grow.

The Government also has asked the Premier League to "step up its contingency planning" for coronavirus, a letter sent to club bosses states. Guidance sent to clubs explained that although the current position remains one of "business as usual", if the situation worsens they will consider "all the available options for completing the season". The email makes clear that protecting players and managers will have a big impact on whether the remaining fixtures are fulfilled.

On Wednesday the UK saw its biggest day-on-day increase in coronavirus cases, bringing the total number to 87. Playing fixtures behind closed doors is the main contingency plan being considered by the Premier League, should the spread of coronavirus necessitate it, although at present matches will go ahead as planned.

The guidance also notes that the Government has laid out three different categories of contingency plans and could intervene if the situation changes. While the Premier League is currently in Category A, described as "as you are", it says that Category B would be "behind closed doors" and then Category C is "cancellation, curtailment or postponement".

The main advice to clubs is that increased care needs to be taken with hygiene and steps must be taken to limit access to stadiums and training grounds. Several clubs have already taken their own action, including stopping players signing autographs, having 'selfies' with fans and shaking hands with club staff. A planning and coordination team within the Premier League has been set up to lead on the coronavirus response efforts.There are nine Premier League fixtures this weekend.

Protection from liability

Welcome to the Tim Meakin from Toton in Nottingham blog. The UK government has adopted a non-interventionist approach to sport and there is no general law of sport. Instead, the regulation of individual sports is largely left to their national governing bodies (NGBs), which are autonomous bodies whose authority derives from a voluntary agreement between the NGB and its members, with the government only intervening where it is deemed in the public interest to do so.

Participants in sport do not enjoy blanket immunity from criminal or civil sanctions for their actions while participating in sport.

In a civil context, participants in professional sport owe a duty of care to one another, meaning they must not act negligently, recklessly or with the intention to cause harm but must instead exercise reasonable care in all circumstances. The precise nature and scope of that duty of care will differ according to the rules and characteristics of the sport in question. Unless a sport has a specified dispute mechanism by which its participants are bound, then its participants will be entitled to pursue civil claims against one another for any damages suffered (ie, personal injury claims).

In a criminal context, there is a general concept of implied sporting consent, providing sporting participants who commit dangerous acts (that might otherwise give rise to criminal liability) an exemption to being charged, provided the act in question falls within the boundaries of what could reasonably be expected in their sport. Even acts that breach of the rules of the sport may nevertheless be consented to if they fall within the practices of the sport, a concept widely referred to as the ‘playing culture’ of a sport.

Tim Meakin Nottingham on Brexit

Welcome to the Tim Meakin blog. Tim Meakin advises on commercial and regulatory matters relating to the sports, eSports, sponsorship and advertising industries from Toton in Nottingham. On 23 June 2016, 17,410,742 people in the UK voted to leave the European Union. Article 50 of the Lisbon Treaty was triggered by Theresa May on 29 March 2017, meaning that the UK will exit the EU on 29 March 2019.

The UK and the EU will have until this exit date to negotiate terms unless transitional arrangements are agreed that enable discussions to continue beyond March 2019. It is important to remember that until the exit date, EU law will continue to apply in this country and there will be no immediate change in the way that people move or trade. Businesses should however start to consider now how Brexit may affect them so that appropriate measures can be put in place well in advance of the exit date. These will be dependent on the sector and the cross-border nature of the business.

The discussions on the terms of the UK's exit began in Brussels on 19 June 2017. Agreement will need to be reached on a number of matters, including the costs that the UK will have to pay the EU on exit; its trading relationship with the EU; immigration and border controls; the proposed regulatory framework; state aid; research and innovation programmes across the EU and UK; and defence and security cooperation.

The Prime Minister has announced that her government will introduce a Great Repeal Bill revoking the European Communities Act 1972, which provides legal authority for EU law to have effect in the UK, and transfer all EU laws currently in force onto the UK statute books.
